Please read these Terms of Service carefully. They contain important information that affects your rights, remedies, and obligations. They include an agreement to arbitrate (unless you opt out). These terms also include a prohibition of class and representative actions and non-individualized relief for all matters in either court or arbitration, various limitations and exclusions, a clause that governs the jurisdiction, venue, and governing law of disputes (except where prohibited), and obligations to comply with applicable laws and regulations.
WI Exotic Rental offers an online platform where individuals can book vehicles for personal use, whether traveling locally or from out of town. By accessing our website or mobile application, you agree to follow these Terms of Service and all additional policies referenced here. These Terms apply to both vehicle renters and owners and form a binding agreement between you and WI Exotic Rental.
Modification
We may update these Terms or any part of our service at any time. Any updates will be posted with a revised effective date. Your continued use of our platform after changes means you accept the updated Terms. If you don’t agree with the changes, you must stop using the platform and close your account within 30 days.
Eligibility, registration, verification
Guests must meet local eligibility rules and have a valid driver’s license. Hosts must be at least 21 years old and list legally registered, safe vehicles. In some regions, hosts as young as 18 may be eligible.
To use our Services, you must create a WI Exotic Rental account by providing accurate contact and identification details. Hosts and guests may be asked for additional information to verify identity or vehicle eligibility. You are responsible for keeping your account details up to date and secure.
We may perform ID checks, license verification, driving history checks, and vehicle eligibility reviews using internal tools or third-party providers. Submission of your information implies consent to this verification. We reserve the right to approve or reject any booking or listing at our sole discretion.
Consumer report authorization
You authorize us to request credit, driving, or background checks where allowed by law. This may include insurance scoring, license validity, or criminal record reviews. We use this information to protect our platform and community.
Rental costs, protection plans, extras, and other applicable charges will be clearly shown before checkout. When you add a payment method, you authorize WI Exotic Rental to charge it for any relevant fees. Stored payment details may be updated by your card issuer, and we may use those updates automatically.
If you owe us money, we may use all legal means to recover the amount, including third-party collection agencies. Non-payment may affect your credit. You’re responsible for any collection or legal fees associated with unpaid balances.
In some regions, we are required to collect and remit taxes on bookings. These taxes will appear clearly on your receipts. Where applicable, we report gross earnings for hosts to tax authorities as required by law. You consent to receive tax documents electronically.
You agree to use our Services legally, responsibly, and according to these Terms. You are solely responsible for all activity on your account. Keep your login credentials secure and report any unauthorized activity to us immediately.
WI Exotic Rental Content and User Content License
We grant you a limited, non-transferable license to access content on our platform for personal, non-commercial use. You may not reuse or reproduce any content without our written permission.
User Content
You may upload content (such as vehicle photos or reviews). By doing so, you grant WI Exotic Rental a worldwide, royalty-free license to use and promote this content. We don’t claim ownership of your content, but we may display or share it to promote the platform.
Copyright protection
We respond to valid copyright infringement notices and may terminate user accounts involved in repeated violations. If you believe your copyright has been infringed, please contact us with proper documentation.
Google terms
Some features use Google Maps/Places APIs and reCAPTCHA Enterprise to prevent spam. By using our services, you agree to Google’s Terms of Service.
Users of WI Exotic Rental agree not to:
Violate any applicable laws or regulations.
Post false, misleading, or defamatory content.
Infringe on copyrights, trademarks, or intellectual property.
Impersonate others or provide false personal information.
Attempt to bypass our platform to avoid fees (e.g., off-platform bookings).
Engage in harassment, discrimination, or abuse toward others.
Interfere with platform security or functionality.
Use bots or scraping tools to extract platform data.
Rejoin the platform under a new account if previously suspended.
WI Exotic Rental reserves the right to investigate and take action against any misuse of our platform. This includes removing content, suspending accounts, and involving legal authorities when necessary. We may adjust enforcement based on user history and context.
Communications with You
By using our services, you consent to being contacted via email, messages, or calls (automated or otherwise) for account verification, updates, or security matters. You may opt out of texts by replying “STOP.” Communications may be recorded for quality and training purposes.
Insurance and Protection Plans
WI Exotic Rental is not an insurance provider. Any optional protection plans offered are subject to separate terms and available only in specific regions. Guests and hosts must comply with our terms to be eligible for any protection benefits.
Guest commitments
If you’re booking a vehicle through our Services, you must hold a valid driver’s license and present it to the host or upload it on the platform. You’re expected to handle the vehicle and any additional items responsibly and return them on time in the same condition. Only drivers listed in the booking as “Approved Drivers” are allowed to operate the vehicle.
No right of withdrawal
If you’re a resident of the European Economic Area or the UK, you don’t have a legal right to withdraw from your booking, as it’s tied to a specific date. Your rights are instead covered under our cancellation policy. However, you can change your selected protection plan before the reservation starts.
Financial responsibility for vehicle damage
The person who books the trip (the “primary guest”) is responsible for any damage to or theft of the vehicle during the trip, regardless of who’s at fault. This applies even if you have personal insurance. WI Exotic Rental may assist with filing a claim through your insurance.
You can limit your personal liability by selecting a protection plan. This limit only applies if both you and any Approved Driver follow the Terms and if the damage is not mechanical or internal. Plans can be changed before the trip begins under ‘modify trip.’
Auto liability insurance
Hosts do not provide liability insurance. In the US, UK, Canada, and France, WI Exotic Rental includes liability coverage as part of the trip. The specifics depend on where the trip starts. In Australia, guests receive protection through a mutual risk-sharing group rather than traditional insurance.
Using the vehicle
Vehicles must only be used for personal or approved professional use. Commercial use is not allowed unless WI Exotic Rental has provided prior written consent. You must return the car on time, drive responsibly, follow all laws, wear seat belts, and ensure child safety laws are followed. Do not leave the car running or unlocked. Misuse of the vehicle may void your protection plan and make you liable for all damages.
Telematics and vehicle data
Some vehicles are equipped with systems that collect real-time data (e.g., speed, mileage, fuel levels, location). By booking a vehicle, you consent to the collection and sharing of this data where permitted by law. You are also responsible for informing others riding with you. WI Exotic Rental and its partners are not liable for any failure of these systems.
Condition of the vehicle and Extras
Each host is responsible for keeping their vehicle legally compliant and roadworthy. Inspect the vehicle before starting your trip and upload photos of any damage to avoid liability. If the vehicle appears unsafe, do not use it and contact WI Exotic Rental immediately.
Lost or stolen items
WI Exotic Rental is not responsible for the vehicle’s legal condition or any items lost, stolen, or damaged during a trip. This includes vehicle status, title status, and eligibility.
Incident reporting
Report any vehicle damage immediately via the platform. In case of collisions, also report to the police as required by your location. Cooperate with all investigations and provide any information or evidence requested. You may not continue the trip without WI Exotic Rental’s approval after a major incident.
Vehicle theft
WI Exotic Rental may report the vehicle as stolen if:
It’s not returned on time.
It’s returned to a location not agreed upon.
You provide false info or refuse communication.
Keys are left in the car or it’s left unlocked.
The vehicle is misused or driven by an unapproved driver.
If a vehicle is reported stolen, a $500 administrative fee and investigative costs may apply.
Repossession and missing vehicles
WI Exotic Rental or the host may repossess a vehicle if it’s not returned, illegally parked, or used unlawfully. If the vehicle goes missing, immediately return the key, file a police report within 12 hours, and cooperate fully.
Host commitments
As a host, you agree to provide a legally registered, insured, and safe vehicle with valid plates and a clean title. Only guests listed on the booking as Approved Drivers may drive the vehicle. You must not collect extra personal information from guests or misuse the data provided by WI Exotic Rental. Listings must be accurate, and you must honor pricing and reservation details. Vehicles must not be under recall, salvaged, or equipped with illegal modifications. Remove any weapons from your vehicle. If you use any third-party services or hardware, you authorize WI Exotic Rental to access relevant data.
Vehicle information and listing conditions
You must only list vehicles that meet WI Exotic Rental’s requirements and that you legally own or control. If your vehicle uses GPS or other tracking devices, you must comply with all applicable regulations and inform WI Exotic Rental. WI Exotic Rental determines listing rankings based on multiple factors including price, location, ratings, and guest preferences — you cannot pay to increase your ranking.
Exclusive listing
In the US and Australia, vehicles listed on WI Exotic Rental must be exclusive to the platform. Listing the same vehicle on other car-sharing platforms may lead to penalties or account suspension.
Photography
If WI Exotic Rental provides professional photos of your vehicle, you may use them for your listing. However, WI Exotic Rental owns or holds exclusive rights to these images. You must not reuse them elsewhere and must stop using them if they no longer represent your vehicle. You may be required to sign additional documents to help WI Exotic Rental secure its rights.
Vehicle availability
Once booked, the vehicle must be made available or delivered on time. If you specify a pickup location, it must be accurate, and the vehicle must be present at that location. To qualify for protection plans, verify that the person picking up the vehicle is the same as the one listed on the trip and has a valid driver’s license.
You will have the ability to set and revise the vehicle’s pricing as you choose. WI Exotic Rental will pay you the amount collected from guests that book your vehicle, less the applicable fees payable to WI Exotic Rental. A description of fees can be found here. To the extent you owe WI Exotic Rental or any third-party lender money for any reason, WI Exotic Rental also reserves the right to deduct those amounts from your earnings payment, debit your bank account, charge any of your payment methods on file, and/or send you an invoice.
In some countries, payment processing services are provided by Stripe and subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (collectively, the “Stripe Terms”). In countries where you receive payment proceeds via Stripe, you agree to be bound by the Stripe Terms, which may be modified from time to time. You also agree that WI Exotic Rental is not liable in cases where Stripe processes a payment late or makes a mistake relating to a payment or a payment hold.
As a condition of WI Exotic Rental enabling payment processing services through Stripe, you authorize WI Exotic Rental to obtain all necessary access and perform all necessary activity on your Stripe Connected Account to facilitate sharing of your vehicle. You further agree to provide accurate, complete, and updated information about you to WI Exotic Rental and Stripe. You acknowledge that WI Exotic Rental and Stripe are unrelated entities.
Some airports where you offer delivery may take the position that you must have a permit to use airport premises and remit fees. While WI Exotic Rental does not believe that rental car permits should apply to peer-to-peer car sharing, not all airport authorities agree with this position.
There is personal vehicle sharing legislation that may apply to you.
You are required to regularly check your vehicle for any defects in its operations or safety. You promise that, at all times, your vehicle will be in safe and roadworthy condition, in good mechanical condition, and in full compliance with all applicable inspection and registration requirements, including any required safety inspections. You will only list vehicles with a clean, non-salvaged, non-written off, non-washed, and non-branded title.
If WI Exotic Rental believes that your vehicle does not conform to reasonable standards, including maintenance standards, WI Exotic Rental may notify you and reserves the right to remove or decline listing your vehicle until its concerns have been resolved.
Permissions & Obligations
By adding a Co-host to a hosting team, you represent and warrant that each such Co-host is authorized by you to act on your behalf. You are responsible for your Co-host’s permissions, behavior, and legal compliance.
Not Employees
No Co-host or host is an employee of WI Exotic Rental. Any agreement between you and your Co-host does not create an employment relationship with WI Exotic Rental.
If you did not decline a protection plan provided by WI Exotic Rental and you believe a guest has caused any damage to your vehicle, you must report the damage within 24 hours after the scheduled end of the trip.
Our team or third-party investigators will determine if the damage occurred during the trip. If it qualifies, WI Exotic Rental will reimburse you as outlined in your protection plan. If more damage is discovered during repair, follow our supplemental payment request process.
For trips originating in the United States, United Kingdom, France, and Canada, hosts are covered under a third-party automobile liability insurance policy arranged through Exotic Car Rental. These policies vary based on region but are designed to provide protection for third-party injury or property damage. Specific coverage is provided by our insurance partners, and Exotic Car Rental does not offer direct indemnification.
For trips in Australia, Exotic Car Rental offers protection plans including legal liability protection through our local affiliates and regulated partners. These plans are issued via licensed providers and are not considered traditional insurance but offer similar legal protection.
Exotic Car Rental’s protection plans for hosts in the US, UK, Canada, France, and Australia include reimbursement for physical damage during a trip, including collision and comprehensive incidents, subject to specific terms and exclusions.
If Exotic Car Rental or a third-party administrator opts to pay the actual cash value for your damaged vehicle, you must either transfer the vehicle title and deliver the vehicle or retain the title and accept a reduced payout equal to the salvage value, as determined by the highest third-party salvage quote.
Host protection plans do not cover:
Optional extras or personal property (e.g., phone mounts, custom equipment)
Normal wear and tear
Vehicles listed with inaccurate information or violations of Exotic Car Rental’s policies
Any misrepresentation or policy violation may void your protection plan, regardless of whether the falsehood contributed to the damage claim.
You must maintain up-to-date registration, your own legally required insurance coverage, and accurate policy information in our system. Exotic Car Rental reserves the right to request your insurance details and updates. Where legally permitted, you authorize Exotic Car Rental to act on your behalf in insurance matters, including claim filing, communication with authorities, and payment administration.
If a vehicle under a protection plan goes missing, is not returned, or is suspected stolen during a trip, contact Exotic Car Rental immediately and follow our instructions. You may be required to file a police report within 24 hours if instructed.
For Quebec hosts, Exotic Car Rental is granted temporary use of your vehicle during the sharing period, with the obligation to preserve its condition. This obligation is fulfilled by obtaining commercial automobile insurance coverage in compliance with Q.P.F. no. 1 standards in Quebec.
If a guest or Exotic Car Rental causes damage to your vehicle and you have a valid protection plan, we or our insurers will defend and indemnify you, provided you comply with our terms. This includes giving prompt notice of claims, allowing Exotic Car Rental full control over legal defense, and cooperating fully. If you receive third-party compensation for a previously reimbursed loss, you agree to return an equivalent amount to Exotic Car Rental.
DISPUTE RESOLUTION FOR HOSTS AND GUESTS RESIDING IN THE UNITED STATES
Please read this section carefully. It includes a mandatory arbitration clause that affects your legal rights.
Any dispute or claim between you and WI Exotic Rental relating to these Terms, your use of our Services, or any breach or termination thereof shall be resolved through binding arbitration, as described below.
APPLICABLE LAW
This arbitration agreement is governed by the Federal Arbitration Act. Where state law is applicable, Arizona state law shall apply.

Both parties agree that all disputes or claims related to WI Exotic Rental—whether based in contract, tort, regulation, or statute—will be resolved via binding arbitration. This includes claims related to your account, vehicle listing, bookings, damage, or violations of these Terms.

Claims eligible for small claims court
Intellectual property disputes
Matters non-arbitrable by law
Public injunctive relief in California (subject to arbitration of all other claims)

CONFIDENTIALITY
All proceedings and records of arbitration are confidential, unless disclosure is required to enforce or implement the outcome.
SEVERABILITY
If any part of the arbitration agreement is deemed unenforceable—other than the class action waiver—the remainder remains valid. If the class action waiver is voided, the entire arbitration agreement becomes void, but all other Terms still apply.
FUTURE AMENDMENTS TO THE AGREEMENT TO ARBITRATE
If WI Exotic Rental updates the Agreement to Arbitrate in the future, the amendment will not apply to any claim filed prior to its effective date. You may close your account within 30 days if you disagree.
JUDICIAL FORUM FOR LEGAL DISPUTES NOT SUBJECT TO ARBITRATION
Unless otherwise agreed, any claim not subject to arbitration will be resolved exclusively in a state or federal court located in Phoenix, Arizona.
PROHIBITION OF CLASS AND REPRESENTATIVE ACTIONS AND NON-INDIVIDUALIZED RELIEF
The parties agree that each may bring claims only in an individual capacity and not as a class or group. No consolidation or class arbitration is allowed.

The laws of Arizona govern these Terms, except for claims originating in California, where California law applies.
